FSA statement on future food regulation

FSA's purpose is to make sure that people have safe food, food they can trust, and that it is what it says it is. They need to change the way food is regulated in England, Wales and Northern Ireland, so we can be confident this stays the case for the food people buy and eat.

Business innovation has outstripped the way regulation has always been done and they need to keep pace with this new world to stop people being put at risk. FSA wants businesses to take proper responsibility for food safety and local authority resources to be properly used.

Safety will always be at the heart of what we decide to do. FSA is proposing a model that continues to use inspections and visits alongside the information they can gain from business’s data and accredited third party audits to ensure that food safety and authenticity are top of a food business’s mind every day – not just on inspection day.

​FSA has started a three month trial to compare the vast amounts of data held by food businesses with the data that local authorities collect from inspections to see if it can be used to provide assurance that they are doing the right things for consumers. This is part of us setting the standard to create a new, more comprehensive and transparent system of business assurance.

European Food Safety Authority seeks stakeholders

The European Food Safety Authority (EFSA) – which provides scientific opinions and advice that form the basis of European policies and legislation on food safety – is changing and broadening its approach to stakeholder engagement.

EFSA has identified the following groups as their stakeholder base:


  • Consumer organisations „
  • Environmental/health NGOs and advocacy groups „
  • Farmers and primary producers „
  • Business and food industry associations
  • Distributors and HORECA (businesses that prepare and serve food and drinks) „
  • Practitioners’ associations (eg. vets and medics) „
  • Academia.

​To be eligible to register as a stakeholder, relevant bodies must be legally established in the EU/EEA and active at EU level. However, organisations that do not fall into this category can still seek to support and guide EFSA through their relevant EU-level body.

Food Hygiene is getting easier to spot in Northern Ireland

Starting from today, Friday 7 October, people in Northern Ireland will find it easier to see the food hygiene rating of places they eat out or buy food, as food businesses will now have to display their rating sticker by law.


The Food Hygiene Rating Act (Northern Ireland) 2016 and associated regulations have come into force, and this new legislation means that the Food Hygiene Rating Scheme is now mandatory, replacing the voluntary scheme run since the end of 2011 by district councils and the Food Standards Agency (FSA).

No matter what the rating of the food business, they will have to by law display the rating sticker given by the district council following inspection. This can range from ‘5’ which means the food hygiene standards are very good, down to ‘0’ where urgent improvement is necessary. This instant and visible hygiene rating information will help people choose where to eat out or shop for food, including restaurants, pubs, cafes, takeaways as well as supermarkets, other food shops and hospitals, care homes and schools.

Head of Local Authority Policy and Delivery at the FSA in Northern Ireland, Michael Jackson, said: ‘This is a major step forward in providing people with hygiene information to help them make informed choices about where to eat out or purchase food and it will also help to improve food hygiene standards in food businesses, as the mandatory display will encourage businesses with a poor rating to improve their standards and strive for a better rating. 

Any food business should be able to achieve and maintain a 5 rating as it only requires compliance with hygiene requirements set down in law. We know that display of stickers has been low in the voluntary scheme, but with this new legislation people will soon be able to check the rating by looking for the sticker and choose somewhere that has a rating of 3 or above. If you can’t see the sticker, then ask the staff. Under the Act staff must tell you the rating if asked.'

Over the next few months more stickers will be seen, displayed in locations where they can be easily spotted before you go in to get food. Next year as a result of a further regulation, businesses which offer on line ordering of food will need to publish their rating online so it can be seen before an order is placed. ​The FSA has built a case for mandation in England using evidence from Wales where display is mandatory and where there has been an increased positive impact on hygiene standards compared with England. It is also exploring how a viable statutory scheme could be delivered in the future in line with the FSA’s Regulating our Future programme. In the meantime the current voluntary scheme in England is being aligned with the statutory schemes in Wales and N Ireland as far as possible without legislative requirements.
